  • Terms and Conditions
  • These Terms and Conditions (“Agreement”) apply to all services provided by King’s Tree Service, Inc. (“Company”) to the client (“Client”). By hiring our services, the Client agrees to the following terms:
  • 1. General Acknowledgement of Risk
    Tree care services involve inherently dangerous activities. Despite our commitment to best practices, the condition and behavior of trees can be unpredictable due to environmental factors such as weather, soil conditions, pests, and natural decay.
  • Client accepts that the potential for tree failure, branch breakage, or other hazards cannot be fully eliminated.
  • The Company is not liable for damage or injury resulting from future tree failures after services are performed.
  • 2. Tree Health Disclaimer
  • Trees are living organisms that may become sick, diseased, or die from causes beyond human control.
  • The Company does not guarantee the long-term health, stability, or survival of any tree.
  • The Company cannot detect every hidden defect, pest, or disease that may compromise a tree.
  • 3. Property and Utility Disclaimer
  • Client is responsible for identifying and marking underground systems prior to scheduled work.
  • While we take measures to minimize disruption, the Company is not responsible for damage to sprinkler systems, irrigation lines, or any underground utilities that are not properly marked or disclosed by the Client.
  • 4. Palm Trees
  • As per standard practice in Arizona, the Company may use climbing spikes (also known as gaffs) when servicing fan palms and date palms.
  • Although some arborists advise against spikes in certain climates, the Company deems this method safe and efficient in Arizona’s dry conditions.
  • By hiring our services, the Client acknowledges this practice and assumes all responsibility for any potential effects on the health or appearance of their palms.
  • Palm trees, particularly older specimens, are naturally prone to decline or failure over time. The Company is not responsible if a palm tree shows signs of stress, decline, or dies following trimming or removal of dead material.
  • 5. Payment Terms
  • Payment in full is due within 30 calendar days from the invoice date, unless otherwise agreed in writing.
  • A 3% processing fee will be added to all credit card payments.
  • Any invoice not paid within 30 days will be considered overdue.
  • Overdue accounts are subject to a late fee of 5% per month (or the maximum rate permitted by law) until paid in full.
  • Client is responsible for all costs of collection, including reasonable attorney’s fees, court costs, and administrative expenses incurred by the Company in recovering overdue balances.
  • 6. Client Responsibility
  • The Client is encouraged to discuss any concerns about their trees before work begins.
  • The final decision regarding tree management rests with the Client, who assumes all associated risks.
  • 7. Permits, Access, and Permission
  • The Client is solely responsible for obtaining any necessary permits, consents, or permissions required prior to the commencement of work. This includes, but is not limited to, approvals for access to the property, traffic control arrangements, lane or road closures, and coordination with utility providers. The Company is not responsible for delays, fines, or additional costs resulting from the Client’s failure to secure such permits or permissions in advance.
  • 8. Limitation of Liability
  • The Client is solely responsible for obtaining any necessary permits, consents, or permissions required prior to the commencement of work. This includes, but is not limited to, approvals for access to the property, traffic control arrangements, lane or road closures, and coordination with utility providers. The Company is not responsible for delays, fines, or additional costs resulting from the Client’s failure to secure such permits or permissions in advance.
  • 9. In Case of Dispute
  • This Agreement shall be governed by and interpreted in accordance with the laws of the State of Arizona.
    Any disputes arising under this Agreement shall first be addressed through good-faith negotiation between the parties.
  • If resolution cannot be achieved through negotiation, the parties agree to participate in mediation conducted in Arizona with a mutually agreed mediator.
  • If mediation is unsuccessful, disputes shall be submitted to binding arbitration in the State of Arizona, and any court proceedings that may follow shall be brought exclusively in the state or federal courts located within Arizona. The Client consents to the jurisdiction of such courts. In any arbitration or court proceeding, the prevailing party shall be entitled to recover its reasonable attorney’s fees and costs from the non-prevailing party.
  • 10. Governing Law
  • This Agreement shall be governed by and interpreted in accordance with the laws of the State of Arizona.
